These terms govern your use of the StayOps platform and website. By using StayOps, you agree to these terms. If you don't agree, don't use the platform.
We've written these to be readable, not to bury things in legalese. If something doesn't make sense, email hello@stayops.pro and we'll clarify.
1. What StayOps is
StayOps is a B2B operations and guest experience platform for short-term rental operators. We connect to your existing property management system (PMS) and layer on tools for turnover coordination, guest communications, digital guidebooks, and operational reporting.
StayOps is sold through custom engagements — not self-serve signups. Each instance is configured specifically for your operation.
2. Your account
You're responsible for maintaining the security of your account credentials and for all activity under your account. If you suspect unauthorized access, notify us immediately at hello@stayops.pro.
You must provide accurate information when setting up your account. One account per operator — don't share credentials across organizations.
3. Acceptable use
Use StayOps for its intended purpose: managing your short-term rental operations. Don't:
- Attempt to access other operators' data or accounts
- Reverse-engineer, scrape, or probe the platform's infrastructure
- Use the platform to send spam or unsolicited messages to guests
- Resell access to your StayOps instance without our written consent
- Upload malicious code or attempt to disrupt the service
We reserve the right to suspend accounts that violate these terms.
4. Your data
You own your data. Property listings, guest information, reservation data, guidebook content, and operational data you create or import through StayOps belong to you.
You grant us a limited license to process your data solely for the purpose of delivering the StayOps service. We don't use your data for training, analytics products, or anything beyond running your instance.
If you leave StayOps, we'll export your data in a standard format upon request and delete it from our systems within 30 days of account closure. See our Privacy Policy for details.
5. PMS credentials
To power your StayOps instance, you provide API credentials for your property management system. These credentials are encrypted at rest and used exclusively to sync data between your PMS and StayOps.
You're responsible for ensuring you have the authority to grant this access. If you rotate credentials in your PMS, update them in StayOps to maintain connectivity.
6. Intellectual property
The StayOps platform, brand, design, and codebase are owned by StayOps. Your engagement doesn't transfer ownership of the platform to you.
Content you create within StayOps (guidebook text, custom messaging, branding assets you upload) remains yours. We don't claim ownership of your content.
7. Founding Engagement terms
StayOps is currently onboarding through a Founding Engagement model. As a Founding Engagement client:
- Your pricing is locked for the duration of your engagement
- You receive priority access to new features and direct input on the roadmap
- Monthly platform fees begin after your instance is live and configured
Specific engagement terms (scope, pricing, timeline) are documented in your individual engagement agreement, which takes precedence over these general terms where they conflict.
8. Service availability
We aim for high availability but don't guarantee 100% uptime. The platform depends on third-party services (your PMS, our hosting provider, authentication services) that are outside our direct control.
We'll notify you of planned maintenance in advance. For unplanned outages, we'll communicate status and estimated resolution as quickly as possible.
9. Limitation of liability
StayOps is provided “as is.” We don't guarantee that the platform will be error-free, uninterrupted, or that it will meet every specific requirement of your operation.
To the maximum extent permitted by law, StayOps' total liability for any claims arising from your use of the platform is limited to the fees you've paid to StayOps in the 12 months preceding the claim.
We are not liable for indirect, incidental, or consequential damages, including lost revenue, lost bookings, or data loss caused by factors outside our reasonable control.
10. Termination
Either party can terminate the engagement with 30 days' written notice. Upon termination:
- We'll export your data upon request
- Your PMS credentials are deleted immediately
- Platform data is deleted within 30 days
- Outstanding fees through the termination date remain due
We may terminate immediately if you materially breach these terms (e.g., attempting to access other operators' data).
11. Governing law
These terms are governed by the laws of the State of Florida. Any disputes will be resolved in the courts of Osceola County, Florida.
12. Changes to these terms
If we make meaningful changes, we'll update the date at the top and notify active customers by email. Continued use of the platform after changes constitutes acceptance.
